Life-Safety & Emergency Disclaimers
Critical legal disclosures regarding non-medical status, emergency service limitations, and equipment reliability.
๐ก๏ธ 1. Non-Medical & Life-Safety Disclaimer
TringHome is strictly a family video communication and photo speed-dial application.
The software is designed for convenience and social connection between family members and caregivers. It is NOT a certified medical device, NOT a Personal Emergency Response System (PERS), NOT a fall detector, and NOT an active safety or continuous supervision service.
Internet-based video and voice calls over Wi-Fi or mobile data DO NOT SUPPORT 911, 112, 999, or any public emergency response services. Users and caregivers must never rely on TringHome for life safety, physical protection, or critical medical care.
Please carefully review how emergency and telecommunication calls operate within TringHome:
•No Emergency Services via Internet (VoIP / WebRTC): Voice and video calls initiated over internet (Wi-Fi or cellular mobile data) cannot connect to local public emergency response centers (such as 911, 112, or 999) and cannot transmit geographic location data to emergency dispatchers.
•Cellular SIM Telephony (Optional BYOD Feature — Carrier Plan Not Included): TringHome subscriptions do NOT include cellular airtime, mobile voice/data plans, SIM cards, or telecommunication carrier service. If the user installs an active, compatible cellular SIM card into a cellular-capable Android phone or tablet, standard phone calls operate via the device's native cellular telephone radio and the user's chosen third-party carrier (billed separately by that carrier). While caregivers can add verified cellular phone numbers to the whitelist, TringHome does not operate the carrier network and cannot guarantee cellular reception, tower signal, carrier availability, or emergency routing.
•Dedicated Emergency Equipment Required: If a senior has critical medical conditions, severe mobility restrictions, or urgent safety needs, caregivers must provide certified medical alert hardware or a dedicated telephone programmed to reach local emergency services.
โก 3. No Guarantee of Continuous Operation & Limitation of Liability
Consumer Android tablets and smartphones rely on third-party hardware, operating systems, electrical power, and internet service providers. By using TringHome, you acknowledge and agree that:
•Devices may run out of battery, experience power loss, disconnect from Wi-Fi, experience carrier network outages, or undergo operating system updates that momentarily interrupt connectivity.
•Although TringHome Home features automatic boot recovery on supported Android configurations, hardware state transitions or battery exhaustion may prevent immediate reconnection.
•Limitation of Liability: To the maximum extent permitted by applicable law, TringHome, its officers, employees, and affiliates shall NOT be liable for any personal injury, medical emergency, emotional distress, or damages arising from missed calls, delayed notifications, network unavailability, or reliance on the service for physical safety or elder supervision.
Terms of Use & Subscription Agreement
Rules governing account registration, subscription billing cycles, calling allowances, and service modifications.
๐ค 4. Service Eligibility & Caregiver Administration
TringHome is designed for families caring for aging relatives. By registering an account or pairing a device, you represent and agree that:
•You are at least 18 years of age (or the legal age of majority in your jurisdiction) and possess legal authority to establish this account and configure devices on behalf of yourself or an elder family member.
•You are solely responsible for maintaining the accuracy of whitelist contacts and numbers entered into the caregiver companion application.
To maintain reliable, ultra-low latency HD video calling performance and fair network utilization across all family accounts, subscription intervals and calling allowances are structured as follows:
•Billing Month Definition: For subscription billing periods, renewal dates, and minute quota calculations, one (1) month is strictly defined as thirty (30) calendar days.
•Standard Video Call Minutes Allowance: The Starter Plan includes "Standard Video Call Minutes," which provides up to 1,500 video call minutes per 30-day billing cycle.
•Extended Video Call Minutes Allowance: The Pro Plan includes "Extended Video Call Minutes," which provides up to 4,000 video call minutes per 30-day billing cycle.
•Cellular Carrier Plan Not Included: TringHome subscriptions cover software platform access and internet video calling minutes only. Cellular carrier service, airtime, and SIM cards are NOT included. Any regular cellular phone calls placed over an installed SIM card operate directly via the device's cellular carrier (subject to your carrier's independent plan and fees) and do not consume TringHome internet video calling minute balances.
•Cycle Reset & Non-Rollover: Calling minute allowances reset automatically at the beginning of each 30-day billing interval and do not carry over to subsequent cycles.
•Cancellation & Refunds: You may cancel your subscription at any time via the Account Portal or Caregiver App. When cancelled, access remains active until the end of your current 30-day billing interval. All payments are final and non-refundable once paid; we do not provide refunds or credits once payment is processed, including if you cancel immediately after subscribing or for any partial billing periods.
๐ 6. Policy Updates & Modifications
We may update or modify these Terms of Use, Safety Disclaimers, and Privacy Policy from time to time to reflect product enhancements, security improvements, legal developments, or changes in regulatory requirements:
•Notice of Changes: When modifications occur, we will update the "Last Updated" date at the top of this document. For material updates affecting subscription quotas or data handling, we will notify registered caregivers via the companion application, account portal, or verified contact information.
•Continued Acceptance: Your continued access to or use of TringHome following the effective date of updated terms signifies your agreement to and acceptance of the revised policies. If you do not agree with updated terms, you may cancel your subscription at any time prior to the effective date.
Privacy Policy & Data Protection
Disclosures on personal information, camera permissions, cookies, analytics, and your privacy rights.
๐ 7. Information We Collect
We collect only the minimum information necessary to provide a reliable, spam-free video communication service between family members and caregivers:
•Caregiver Account Information: Phone number or email address, caregiver first and last name, authentication credentials, and subscription status. All billing and card processing is securely handled by our PCI-compliant payment merchant (such as Dodo Payments); we never store raw payment card details on our servers.
•Whitelist Speed-Dial Directory: Names, familial relationship labels (e.g., "Daughter", "Doctor"), contact phone numbers, and profile photos explicitly selected, cropped, and uploaded by the caregiver.
•Device Telemetry & Status: Basic technical device status (current battery percentage, online/offline connectivity heartbeat) so caregivers can see if the senior's tablet or phone is charged and active.
๐ช 8. Cookies, Local Storage & Web Analytics Disclosures
We use strictly limited, privacy-focused web technologies to ensure portal security and understand website usage:
•Essential Local Storage: Our web portal uses browser localStorage solely to preserve authenticated session tokens and paired device identifiers, allowing caregivers to manage subscriptions without re-entering credentials on every page refresh.
•Google Analytics Disclosure: We utilize Google Analytics (Measurement ID: G-Y55781BE4M) on our public marketing pages to collect anonymous, aggregate traffic telemetry (such as page visit volumes, browser type, referral source, and general geographic region). This data contains no personally identifiable family data, senior photos, or phone numbers and is used strictly to optimize website navigation and performance.
•Zero Advertising or Cross-Site Trackers: We do NOT employ third-party advertising cookies, retargeting pixels, or behavioral ad-tracking technologies.
๐น 9. Camera & Microphone Permissions
We take the privacy and dignity of seniors in their private homes with extreme seriousness:
•Active Calls Only: Camera and microphone access on the device is activated strictly during user-initiated or approved family video calls.
•Zero Background Audio or Surveillance: TringHome does NOT perform ambient listening, background audio monitoring, continuous video streaming, or unauthorized surveillance.
•No Call Recordings: Video and voice streams are ephemeral and transmitted using encrypted WebRTC protocols. We do not record, store, or archive the audio or video content of your private family calls on our servers.
๐ 10. Zero Sale of Personal Data & Whitelist Protection
We operate on a straightforward, subscription-funded business model. We do not monetize your family's personal information:
•No Advertising or Data Brokers: We NEVER sell, rent, lease, trade, or monetize your contact lists, senior photos, or behavioral data to third-party advertisers or data brokers.
•Spam & Scam Shield: The senior kiosk runs on a strict whitelist security architecture. Unregistered telephone numbers, unknown callers, telemarketers, and potential robocall scammers are blocked before reaching the senior.
๐ถ 11. Children's Privacy (COPPA & GDPR-K)
TringHome is an elder care platform intended for setup and administration by legal adults and designated family caregivers:
•Caregiver Administration: While family photo speed-dial slots may include photos and phone numbers of children or grandchildren (e.g., grandchildren calling a grandparent), all accounts, permissions, and directory entries must be managed exclusively by an adult parent, guardian, or caregiver.
•No Direct Solicitation: We do not knowingly solicit, collect, or market personal information directly from children under 13 (or under 16 in the European Union). If we become aware that a child under 13 has independently created an account without verified parental involvement, we will immediately terminate the account and purge associated data.
๐๏ธ 12. Data Retention, Compliance Archival & Account Deletion
Caregivers retain control over the active information associated with their family account:
•Active Directory Management: You can edit, replace, or delete whitelisted contacts and photos at any time through the caregiver app or Account Portal.
•Account Deletion & Purge: When you cancel your subscription or request account deletion, active device associations, whitelist directories, and contact photos are removed from our active production systems.
•Statutory & Compliance Data Retention: Notwithstanding account deletion requests, certain business recordsโincluding billing history, payment transaction IDs, security audit logs, fraud prevention records, and regulatory compliance logsโmay be securely retained and archived for a legally required period as necessary to comply with applicable tax, commercial, dispute resolution, or legal compliance obligations (typically up to 7 years, or as mandated by governing law). Once these statutory compliance periods expire, archived records are securely destroyed or permanently anonymized.
•Privacy Rights: We uphold data minimization principles under applicable privacy frameworks, including California Consumer Privacy Act (CCPA) and General Data Protection Regulation (GDPR), subject to legal retention exemptions.
